Heard Mr. T. H. Bewali, the learned Counsel for Appellant. He seeks permission to delete the name of Respondent No.4 - Ramniwas Shriram Tyagi from the array of Respondents. Permission is granted. 2.

By this Application, Appellant seeks condonation of delay in preferring the Appeal. 4.

For the reasons mentioned in the Application, I am satisfied that the delay caused in Yadav VG 1/2

912.caf.2580.18 preferring the Appeal is properly explained and sufficient ground is made out for condoning the delay. 5.

In view thereof, delay in preferring the present Appeal is condoned subject to payment of costs of Rs.500/-. The costs to be deposited with the Vidarbha Lady Lawyer's Association, Nagpur.
