The learned counsel appearing for the petitioners so also the learned Assistant Public Prosecutor in response to the Court's query inform that the Investigating Officer who intend to intervene in the matter had been to the Hon'ble Apex Court. Pursuant to an order of remand by Apex Court, this Court has already recorded a finding in favour of the intervenor that he is not required to be prosecuted. In this view of the matter, we are of the view that the cause for intervening the matter no more survives.

Hence, the application accordingly stands disposed of.

This is an application for direction to hand over the investigation in Crime No.234 of 2004, registered with Dhantoli Police Station to Central Bureau of the Investigation.
