These two applications arise out of Crime No.37/2018 registered with Police Station Civil Lines, Akola for offences punishable under Section 498-A read with Section 34 of the Indian Penal Code on complaint lodged by non-applicant No.2-Deepali Yogesh Lakhade.

In both these applications, applicants are represented by learned counsel Shri S.D.Khati. The State has filed affidavit in Criminal Application (APL) No.443/2018. In the said reply affidavit, it has been stated that after completion of entire investigation, chargesheet is .....2/-

apl443 and 495.18 8 already filed. The reply is filed on 4.5.2018. 3.

In view of filing of chargesheet, learned counsel Shri S.D.Khati for applicants submits that he has instructions from applicants in these two applications to withdraw these applications since they wish to file an application for discharge before Trial court.

Criminal Applications are disposed of as withdrawn with liberty to applicants to file application for discharge before Trial Court.

It is made clear that the case of applicants was not tested by this Court on its own merits and learned Judge below, before whom application for discharge will be filed, shall decide said application in accordance with law. JUDGE JUDGE !! BRW !!
