The challenge is to the order vacating the stay granted on 20/03/2025 in a proceedings arising out of notice under Section 53 of the Maharashtra Village Panchayats Act, 1959.

The learned A.G.P. was asked to take instructions from respondent No.1 as to within how much time, will he decide the proceedings finally.

The learned A.G.P. has taken instructions. He submits that respondent No.1 shall decide the proceedings within eight weeks. 04.
Considering the nature of dispute and the notice under question, which indicates removal of alleged encroachment by cultivating the land. It will be appropriate if respondent No.1 gives priority to the matter, so that the issue will be resolved finally.

Respondent No.1 shall, accordingly, decide the proceedings within four weeks from today. The petitioner shall appear before the Divisional Commissioner on 13th May, 2025. The Divisional Commissioner, in the meantime, shall issue notice to respondent Nos.2 and 3 herein calling

With the above directions, the petition is disposed of with no order as to costs.
