Heard learned counsel for the respective parties. 2.
It is argued that though the appointment of the petitioners have been considered in open category in view of the resolution passed by the Municipal Council in its General Body Meeting dt. 24.02.2012, a show cause notice came to be issued to the petitioners dated 29.06.2019 asking the petitioners to submit the caste validity certificate. 3.
It is submitted that reply to the said show-cause notice was submitted and there is no decision on the same. It is further pointed out that this Court on 10.07.2019 granted interim relief in terms of prayer clause (3), whereby the stay was granted to the effect, operation and implementation of communication dated 31.03.2018 issued by respondent No. 3-Chief Officer, Municipal Council, Murtizapur, Akola.

In the above referred backdrop, it is argued that this petition can be disposed of by directing the Chief Officer to take decision on the show-cause notice issued to the petitioners after considering the reply submitted by them and the Resolution No. 18 dated 24.02.2012 passed in General Body Meeting.

In that view of the matter, we are of the opinion that the purpose will be served if such directions are issued and the petition is disposed of.

Accordingly, we disposed of the present writ petition with direction to the Chief Officer to take decision on the show-cause notice dated 29.06.2019, after hearing the petitioners and considering the General Body Resolution No. 18 dated 24.02.2012 and the reply filed by the petitioners, in accordance with law.
