Apprehending arrest in connection with Crime No.4 of 2017 registered for the offence punishable under Sections 379 and 34 of the Indian Penal Code the applicant seeks pre-arrest bail. According to the Investigating Agency, the applicant is involved in a racket of theft and sale of vehicles. Initially the crime was registered against unknown persons, however, as investigation progressed, the applicant is shown as accused.

The applicant, aged about 24 years, claims to be a businessman and has stated that he is not involved in any other crime/ offence.

By order passed on 5th May, 2017 this Court has granted interim protection to the applicant imposing condition of attendance at Police Station. The Investigating Agency has not complained that the applicant has not cooperated with it. The non-applicant has not been able to point out that custody of the applicant is required for further investigation.

2 aba305.17 Considering the facts of the case, the order passed by this Court on 5th May, 2017, granting interim protection to the applicant, is confirmed.

The application is allowed accordingly.
