First Appeal No.1264 of 2017 In the light of adjudication in First Appeal No.1078/2016 (The Executive Engineer, Nagpur Medium Project, VIDC Nagpur vs. Nama Bhanhji Gajbhiye and ors.) decided on 06/09/2017 as it is found that the compensation determined by this Court has been awarded by the Reference Court, the appeal is liable to be dismissed. Hence by confirming the judgment of the Reference Court the First Appeal stands dismissed. The claimant is at liberty to withdraw the amount of compensation as deposited. No costs.
