The applicant is apprehending arrest in Crime 94/2020 registered with Police Station Ramdaspeth, Akola District Akola for offences punishable under sections 406, 409, 418, 420, 467, 120-B, 021, 506 and 34 of the Indian Penal Code and section 3 of the Maharashtra Protection of Interest of Depositors Act, 1999.

This Court has protected the other Directors of the society.

While it is pointed out by the learned APP Mr. Doifode that the applicant was the Secretary of the society from 01.04.2012 to 17.09.2016, and is held accountable for certain irregularities, in the audit report, it appears that there is no specific or direct allegation of misappropriation and the role attributed is primarily

aba559.20.O.odt mismanagement and lack of supervision. In any event custodial interrogation is not necessary.

The interim pre-arrest protection granted vide order dated 30.09.2020 is made absolute with the only modification that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
