However, the learned counsel Mr. A.D. Mohagaonkar who has filed appearance on behalf of respondent 2 waives notice for respondent 1.

The limited grievance of the petitioner is that his first appeal and second appeal challenging the order of punishment were only partly allowed and since he is aggrieved to certain extent, he preferred review before the respondent 1 under Regulation 92(j) of the Maharashtra State Electricity Distribution Company Limited Employees Service Regulations, 2005 which is not decided.

Mr. A.D. Mohagaonkar would submit that while the respondent 1 shall decide the review, all questions including the maintainability of review, be left open for the respondent 1 to decide.

Respondent 1 shall decide the review preferred by the petitioner within the next ninety days.
