At this stage, learned counsel Mr. Pravin Agrawal submits that instead of rendering an elaborate order, the applicant may be granted permission to withdraw the application with liberty to approach the learned Sessions Judge afresh, if there is no significant progress in the trial in the next six months.

The application is disposed of as withdrawn with liberty as prayed.

It is, however, made clear that the liberty shall be available only, if the absence of progress in the trial is not attributable to the accused, and this order is brought to
