By the impugned judgment, the learned Magistrate dismissed the complaint filed by the present applicant under the provisions of Negotiable Instruments Act. After having gone through the judgment and the proceedings, it appears that the accused paid the entire amount therefore there was no liability on him. He has not given any explanation as to how he has issued the cheque in dispute. Hence, the application is allowed. Leave is granted to file the appeal.
