Pursuant to the order of this Court dated 16.10.2024, the learned Mediator Mr. J. J. Chandurkar has sent a report stating that the matter is settled. During mediation, an agreement of settlement came to be executed by the respective parties.

The respondent Nos.1 to 3 are present. On enquiry with them, they have admitted the execution of the agreement of settlement and also the contents mentioned therein.

Learned counsel appearing on behalf of the appellant submits that the Authorized Officer of Bharati Axa General Insurance Co. Ltd., which is now merged in I.C.I.C.I Lombard General Insurance Co. Ltd., has also signed the agreement of settlement..

The appeal is, therefore, disposed of in terms of the mediation report and agreement of settlement. TAMBE

The appellant and respondent Nos.1 to 3 are permitted to withdraw the amount deposited by the appellant, with accrued interest, if any, as per the terms mentioned in the agreement of settlement and as per the impugned award.

Learned counsel for the respondent Nos.1 to 3 submits that the name of the respondent No.2 is changed after her marriage as Sau. Disha W/o Hemant Purankar and requested to disburse the amount of her share in the bank account created on the said name.

The Registry to disburse the amount granted in favour of the respondent No.2 - Sau. Disha W/o Hemant Purankar in her bank account, after due verification. 8.

The award be drawn in terms of the mediation report and agreement of settlement.
