Heard.

Perused the applications for condonation of delay in bringing the legal representatives of the deceased respondent on record and setting aside abatement.

For the reasons stated therein, if learned counsel for the applicant/appellant deposits amount of costs of Rs.500/- with the High Court Legal Sub Committee, Nagpur, the applications are allowed. Delay in bringing the legal heirs of the deceased respondent on record is condoned. The abatement of appeal so far it relates to the respondent is set aside. The proposed legal heirs of the deceased respondent be brought on record. Necessary amendment be carried out within a .....2/-

cas521 and 522.15 period of one week.

Upon the amendment is carried out, notices be issued to the legal heirs of the deceased respondent within a period of one week, thereafter.

Learned counsel for the applicant/appellant is permitted to serve them, in addition to regular mode of service, by RPAD, as well.

The civil applications are disposed of accordingly subject to payment of costs as aforestated. JUDGE !! BRW !!
