Heard learned counsel Shri A.P.Tathod for the applicant and learned Additional Public Prosecutor Mrs.M.H.Deshmukh for the State. Also, perused reply filed on behalf of the State.

The applicant, who at the relevant time was Extension Officer in Malegaon Panchayat Samiti, district Washim, is apprehending his arrest in connection with Crime No.578/2020 registered with Malegaon Police Station, district Washim for offences punishable under Sections 406, 409, 420, 465, 468, and 471 read with Section 34 of the Indian Penal Code.

The applicant was protected by this Court (Coram : Vinay Joshi, J.) on 23.11.2021 with a condition that he shall attend the police station on days specified in the order.

Yesterday, on a query made to learned Additional Public Prosecutor Mrs.M.H.Deshmukh for the State as to whether the applicant has followed the condition or nor, she sought time, till today, 5.

Today, on the said query, learned Additional Public Prosecutor for the State, upon instructions from Investigating Officer, makes a statement before this Court that in pursuance to the interim order, the applicant has regularly attended the police station and has extended full cooperation to Investigating Officer.

There is nothing on record to show that the applicant will not be available to course of justice. 7.

From reply filed on behalf of the State, it is clear that all documents are seized and are in possession of Investigating Officer. Resultantly, I pass following order:

ORDER

(1) The criminal application is allowed.

(2) In the event of arrest of applicant-Yogeshwar s/o Shrikisan Taktode, in connection with Crime No.578/2020 registered with Malegaon Police Station, district Washim for offences punishable under Sections 406, 409, 420, 465, 468, and 471 read with Section 34 of the Indian Penal Code, he be released on bail on he executing a P.R.Bond in the sum of Rs.25,000/- with two solvent sureties of the like amount.

(3) The applicant shall attend the police station once in a month i.e. on 3rd Friday of every month from 3:00 p.m. to .....3/-

5:00 p.m., till chargesheet is filed.

With this, the criminal applicant is disposed of accordingly.
