DATE : 24-01-2023 Both the learned Counsel for the parties do not dispute the existence of the agreement dated 08-01-2018 (pg 9) and the arbitration clause in term no.12 therein, as well as its invocation.

Mr. Sambre, learned Counsel for the respondent, has today filed a pursis indicating the willingness of the respondent to refer the dispute to Shri Chandrashekhar B. Bhagwat, retired Executive Engineer, PWD, who has expressed his willingness to work as an arbitrator in the matter.

iii.

Mr Uttam Chakrawarty, learned Counsel holding for Mr. Sarada, Advocate for the petitioner, on instructions, states that the name of Shri C.B. Bhagwat is agreeable to the petitioner, considering which, Shri C.B. Bhagwat, retired, Executive Engineer, PWD, r/o. 2, Dhanwantari Colony, Navsari, Amravati, is hereby appointed an Arbitrator to arbitrate in respect of the dispute

iv.

The parties shall appear before the arbitrator on 30-1-2023 and shall place a copy of this order before him to apprise him of the same. The processing charges shall be paid by 27-01-2023 without which the copy of order shall not be issued.
