This is an application for leave to file appeal, challenging the judgment and order of acquittal. The complaint filed on behalf of the applicant was dismissed for want of prosecution. Today, Shri A.J. Mirza, learned counsel for the appellant tendered an affidavit of Deputy General Manager, MOIL, Nagpur, which is taken on record and marked as Exhibit 'X' for the purposes of identification. By the said affidavit, the appellant is praying for withdrawal of the appeal itself.
