The applicant seeks to challenge an order passed by the learned Judicial Magistrate, First Class, Kamtee thereby rejecting the prayer made by the petitioner under Section 156(3) of the Code of Criminal Procedure, 1973.
In view of the decision in Avinash s/o Trimbakrao Dhondage vs. The State of Maharashtra and Anr. 2016 ALLMR (Cri) 985 remedy of filing revision application before the Sessions Court is available. In view of aforesaid and with liberty to the applicant to avail the alternate remedy the present application is disposed of. All points are kept open.
