Shri Borkar, the learned counsel for the petitioners, states that there are several defects in the petition, inasmuch as the petitioners are also not correctly joined. It is stated that though the proprietor of the petitioner no.1 is no more, the petitioner no.1 has been jointed through the power of attorney holder. It is stated that in the body of the petition also, there are several mistakes. It is stated that it would be necessary to withdraw the writ petition and file a fresh petition, as extensive amendment would make the petition cumbersome.
Shri Agnihotri, the learned counsel for the respondents, does not have any serious objection to the prayer made on behalf of the petitioners.
On a perusal of the writ petition and in view of the no objection on behalf of the respondents, we permit the petitioners to withdraw the writ petition with liberty to file a fresh petition, without defects.
The writ petition stands disposed of as withdrawn, with liberty, as prayed for.
