Heard Shri J.B. Kasat, the learned counsel appearing for the Nagpur Municipal Corporation. As per the directions given by this Court on 15th February,2017 in Writ Petition No.4053/1998, the respondent-Nagpur Municipal Corporation was required to publish a notification under section 37(1) of the Maharashtra Regional and Town Planning Act,1966 within a period of ninety days from the date of delivery of the judgment. This Application is made for extension of time to publish such notification. The reasons are stated in paragraph no.2 of this Civil Application which is reproduced below :

That, as per the Government Order dated 10.9.2001, there is a reference about demarcation on the map about the area to be put to action u/s 37 of the MRTP Act, however, the area of the layout came under the jurisdiction of the answering respondent on
30.06.caw.1171.17 27.2.2002 from NIT and therefore as per the available official record the said demarcation map is not on the record of the respondent no.3. As such the same was demanded from the State Government as well as from the NIT however the NIT has shown its inability to supply the same because of its non-availability and they have also requested the same from the State Government. The same is not yet supplied to the Respondent Corporation from the State Government." Keeping in view the difficulty expressed, we extend the time for publication of notification by a further period of three months. The Civil Application stands disposed of.
