The appellant no.3 died on 22.07.2009 after passing of the judgment and decree dated 08.02.2005. As right to sue survives, the leave is granted to file appeal by the legal heirs of appellant no.3 along with appellant nos.1 and 2.

Civil Application is allowed and disposed of. Civil Application St. No.9255/2022 Heard.
