BHATKAR,JJ DATE : 21.1.2015 This petitioner has filed this petition with a grievance that certain irregularities and illegalities have been committed by the officers of the Public Works Department in the improvement work of Tar road between Mahagaon to - Shirfuli, so as to cause loss to the public exchequer. An affidavit in reply has been filed on behalf of the respondents dated 19.8.2014.

In the affidavit, it is categorically stated that the work was done properly. There are no irregularities or illegalities in the said work. The various documents including

certificates from the Sarpanch of the villages have been placed on record certifying that the work of the said road was initially commenced in March, 2014 and completed in the first week of May, 2014. Reply categorically states that the said work was done only for the work which was completed.

No counter affidavit is filed by the petitioner so as to meet out the averments made in the aforesaid affidavit. In that view of the matter, we do not find that any purpose would be served by keeping the present petition pending. The petition is, therefore, disposed of. JUDGE JUDGE patle
