For the reasons set out in the application, the application is allowed.

The claimants are permitted to withdraw the amount 50% of the amount in terms of the judgment passed by the Motor Accident Claims Tribunal, Washim along with accrued interest, on filing an undertaking that in case the appeal is allowed, the said amount shall be repaid with interest at such rate the Court may direct. The application is disposed of in above terms. First Appeal No. 838 of 2009 Stand over after Summer Vacations.
