The learned counsel appearing for the appellant Corporation fairly states that the present appeal would be covered by the judgment and order dated 30.08.2016 passed by this Court in First Appeal No. 486 of 2011 as the said appeal also concerned acquisition of land from the very same village i.e. village Sawardi and it pertained to the very same acquisition proceedings.

In the said judgment, this Court has given reasons as to why the quantum of compensation granted at the rate of Rs.1,00,000/- per hectare by the Reference Court was justified and the appeal has been dismissed.

Hence, for the reasons stated in the First Appeal No. 486 of 2011, the present appeal is dismissed and the judgment and order passed by the Reference Court is confirmed.

Consequently if the appellant- Corporation

FA170-16.odt has deposited the amount of compensation, the respondent no.1 through her legal representatives shall be entitled to withdraw the same, along with accrued interest, if any.
