This is an application for leave to file the criminal appeal against acquittal.

Undisputedly, Exhibit 18 an application to grant the loan was submitted by the nonapplicant with the Bank and in pursuance of that the loan amount was sanctioned. It is not disputed at all by the non-applicant his signature on Exhibit .....2/-

18. On the contrary, he failed to enter into the witness box.

The judgment delivered by the Court below shows that learned Judge has acquitted the non-applicant on flimsy ground.

In that view of the matter, the application is allowed. Leave is granted to the applicant. The criminal appeal is ADMITTED.

Learned counsel Shri Rohit waives notice.
