Hearing was conducted through Video Conferencing and the learned counsel agreed that the audio and visual quality was proper.

Applicant is claiming bail in Crime No.

39/2019 registered by Risod Police Station relating to the offences punishable under Sections 366 and 376 of the Indian Penal Code.

During the course of hearing, learned Additional Public Prosecutor pointed out that

Order 3 LDVCBA467 already this Court has rejected bail application No. 1136/2019 vide its order dated 03.01.2020.

Apparently, the said aspect has not been disclosed by the applicant while claiming bail. When it is brought to the notice of the learned applicant' s counsel, he stated that he was not aware and seeks permission to withdraw with liberty to file fresh. 4.

Liberty is granted as prayed for with specific direction to mention earlier rejection by this Court dated 03.01.2020 in bail application and also produce a copy of said order while applying for bail. With such observations, application stands disposed as withdrawn.

This order be communicated to the counsel appearing for the parties, either on the email address or on WhatsApp or by such other mode, as is permissible in law.
