DATED : AUGUST 28, 2020 Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

It is relevant that an earlier application for bail filed by this applicant bearing Criminal Application (BA) No. 492 of 2019, was rejected on merits by this Court on 17th July, 2019. 3.

A perusal of the present application shows that the aforesaid order is not even mentioned leave alone annexed with the present application.

It is only in the reply filed by the non-applicant / State that the aforesaid order in the bail application was placed before this Court.

Even otherwise, there appears to be no change in the circumstances after the said order dated 17th July 2019, passed by this Court.

In these circumstances and when this Court was not inclined to entertain the present application, the learned counsel appearing for the applicant sought permission to withdraw the present application.

Hence, dismissed as withdrawn.
