Heard Ms. Vidhya Umale, the learned Advocate for the applicant and Shri Rohit Joshi, the learned Advocate for the non-applicant Nos.1 and 3.

The learned Advocates for the respective parties are ad idem regarding appointment of an Arbitrator other than the Divisional Commissioner as per Clause 31 of the agreement. Hence, the following order :

Shri A.V. Bhide, Advocate, W.H.C. Road, Dharampeth, Nagpur is appointed as an Arbitrator to resolve the dispute between the parties.

The applicant and the non-applicant Nos.1 and 3 shall deposit Rs.20,000/- each with the Registry of this Court within four weeks towards security of fees of the learned Arbitrator.

cao.1175.16 2/2 In addition, the applicant and the non-applicants shall pay fees of the learned Arbitrator.

The applicant shall deposit Rs.5,000/- with the Registry of this Court within a period of four weeks towards processing charges.

The application is allowed accordingly.
