Heard learned counsel for rival parties. Perused the FIR as well as injury reports.

The applicants are prosecuted in Crime No.86/2015 for an offence punishable under Sections 326, 323, 143, 147, 148, 149 and 506 of the IPC registered with Police Station, Pusad (Rural), Dist. Yavatmal.

Upon perusal of the FIR as well as the injury reports, I think, prima facie, no case under Section 326 of the IPC is made out. However, quarrel had ensued between the two groups. Thus, in the absence of any criminal background, I think, the applicants can be released on bail by directing them to cooperate with the Investigating Officer during investigation.

aba302.15 Hence, I pass the following order.

ORDER

(i) Criminal Application No.302/2015 is allowed.

(ii) In the event of arrest, the applicants shall be released on bail on their executing PR Bond in the sum of Rs.10,000/- with one surety in the like amount.

(iii) The applicants shall attend Police Station, Pusad (Rural) everyday for a period of one week. (iv) The applicants shall not enter village Dhundi, Tq. Pusad Dist. Yavatmal till the trial is complete. If they make any attempt to enter the village, their bail shall be cancelled.
