Date : 4 th August, 2015 This family court appeal was called for hearing on 19-6-2015, 25-6-2015, 29-7-2015 and 30-7-2015, but the same was adjourned on the aforesaid dates, as the learned counsel for the appellant did not secure any instructions from the appellant as to whether the appeal was required to be prosecuted after a lapse of nearly 10 years from its admission.
Shri Wadodkar, the learned counsel for the appellant, states that the counsel tried his level best to contact the appellant on the address that was mentioned in the petition and available with the counsel and also tried to find out his whereabouts, as he is working on the transferable job. The learned counsel for the appellant shows his inability in seeking instructions. It is stated that the parties resided together for a very short time after the marriage and the decree for divorce was passed in the year 2005. It is stated that in the absence of any instructions, it would not be proper on the part of the counsel to work out a family court matter.
