Ms. Rohini Jaiswal, Advocate holding for Shri A.S. Jaiswal, learned Senior Advocate for the petitioner submits that the Sub-Divisional Officer, Ramtek, has on 29.06.2002 informed the petitioner that the subject land has been excluded from acquisition. A copy of communication is tendered and taken on record as Exh. 'X'.

Ms. T. Khan, learned AGP appearing for the respondents submits that she is not aware of these developments.

However, in view of Exh. 'X', we dispose of the present challenge as infructuous. Rule discharged. No order as to costs.
