Learned Counsel for the petitioner would submit that by virtue of order of this Court, the petitioner was permitted to partake in the recruitment process however he was not selected on merits.

Initial grievance of the petitioner was that certain posts have been advertised by respondent no.1, wherein there was no condition of furnishing domicile certificate. According to the petitioner, in the midway, he was directed to furnish said certificate, which the petitioner did not have as he is resident of Haryana State. The petitioner has challenged the said notice (page 45) dated 05.12.2022 directing to produce domicile certificate.

Since the recruitment is over and the petitioner was not selected in merit, we need not go on said question however, it is kept open to be decided in

2 33.wp.4006.2023 appropriate proceedings whether in the midway a domicile certificate is required for open category candidates for a recruitment held by respondent no.1 in the State of Maharashtra.

The petition stands disposed of in above terms. No costs.
