This application has been vehemently opposed by the learned A.P.P. contending that the applicant has played equal role to that of the main accused Sudhakar Raut and the other accused. This contention cannot be accepted at this stage as in the F.I.R. itself no criminal role has been attributed to the present applicant. The amount of Rs.10 lac, as clearly stated therein, had been paid to Sudhakar Raut and not to the present applicant. What has been alleged about this applicant is that he was one of the persons who had counted the money before it was paid to Sudhakar Raut.

Then, there is no evidence which

0906aba325.16.odt 2/2 specifically shows active involvement of the applicant in the alleged offence. In the result, I am of the view that this is a fit case for grant of anticipatory bail.

The application is allowed.

It is directed that in the event of arrest in Crime No.175/15 registered with police station Rana Pratap, Nagpur for the offences punishable under Sections 420, 467, 468, 471 read with Section 34 of the Indian Penal Code, the applicant shall be released on bail on his furnishing a P. R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like amount on the conditions that the applicant shall attend police station every day for a period of two weeks between 11.00 a.m. to 1.00 p.m. starting from 13/6/2016 and also at such other dates and time required by the investigating officer, that the applicant shall cooperate with the police in the investigation and shall not tamper with the prosecution witnesses.
