The grievance raised by the petitioner in this contempt petition is with regard to non-compliance of the directions issued in Writ Petition No. 5373/2018. While partly allowing the aforesaid writ petition, the following reliefs were granted to the petitioner.
"(a) The respondent nos. 1 to 4 are further directed to refund the amount of Rs.29,793/-,so far recovered from the petitioner, to the petitioner within eight weeks' from the date of the order.
(b) Respondent nos. 1 to 4 are further directed to refund the amount of Rs.1,19,791/- deducted from the gratuity amount payable to the petitioner, within a period of eight weeks from the date of the order."
After the notice was issued in the contempt petition, an affidavit has been filed on behalf of the
917.CP149.20.odt 2 respondent nos. 1 to 3 in which it has been stated that amount of Rs.29,793/- was paid to the petitioner by cheque no. 141809 dated 20.11.2020. Further the amount of pension was also paid to the petitioner by cheque dated 13.11.2020 which includes the amount of gratuity of Rs.1,19,791/-.
In the light of these statements made on oath along with necessary documents, it is clear that the grievance of the petitioner stands redressed. The contempt petition is therefore disposed of.
