This is an application filed by the applicant for condonation of delay in filing the first appeal.
Heard the learned counsel for the parties.
For the reasons mentioned in the said application, I am satisfied that the delay of 508 days for preferring an appeal deserves to be condoned. Hence, the delay of 508 days in preferring an appeal is hereby condoned.
The application stands disposed of.
Civil Application (F) No.249/2018 This is an application filed by the applicants-respondent nos.1 and 2 for grant of permission to withdraw the amount deposited by the appellant.
Heard the learned counsel for the parties.
It is stated by the applicants that on 25.4.2017 the appellantinsurance company had deposited an amount of Rs.11,71,074/- in WC (F) No.13/2013 before the learned Commissioner under Workmen's Compensation Act and Judge, Labour Court, Buldana. Having considered the grounds of appeal and the impugned judgment passed by the learned Commissioner under Workmen's Compensation Act and Judge, Labour Court, Buldana, I am of the view
2 caf3042.17.odt that the amount deposited before the learned Commissioner can be allowed to be withdrawn conditionally.
The permission is granted to respondent nos.1 and 2 to withdraw 50% amount on usual undertaking before the learned Commissioner under Workmen's Compensation Act and Judge, Labour Court, Buldana. The undertaking be furnished within two weeks from today. The application is, therefore, partly allowed. JUDGE Gulande
