The only prayer pressed by the learned Counsel for the petitioner is to take cognizance of the complaints dated 30-11-2022 and 28-02-2023 made by the petitioner in the matter of alleged unauthorized construction stated to be undertaken by the respondent no.2.

While issuing notice it was directed that the respondent no.1 should consider the aforesaid complaints. Today it is submitted by the learned Counsel for the respondent no.1 that the said complaints have been decided and notice under Section 53(1) of the Maharashtra Regional Town Planning Act, 1966 has been issued to the respondent no.2 on 10-07-2023.

In view of aforesaid the purpose for filing the Writ Petition has been served. In case there is no legal impediment, the respondent no.1 shall act in furtherance of the notice dated 10-07-2023.

It is made clear that it would be open for the respondent no.2 to take appropriate steps if he is aggrieved by the aforesaid notice in accordance with the law.
