Shri Patil, the learned counsel for the petitioner states that the petitioner gives up the prayer for the declaration that the petitioner was not appointed on the post that was ear-marked for the V.J. category and was appointed on an open category post. It is stated that the petitioner is ready to get his caste claim verified from the Scrutiny Committee and his services should be protected till the caste claim is decided.

Hence, in view of the aforesaid, we dispose of the writ petition with a direction to the Scrutiny Committee at Akola to decide the caste claim of the petitioner, as early as possible, and positively within a period of nine

months from the date of appearance of the petitioner before the Scrutiny Committee. The petitioner undertakes to appear before the Scrutiny Committee, Akola on 20th April, 2015. The services of the petitioner are protected till the Scrutiny Committee decides the caste claim.

Order accordingly. No costs.
