DATE : 21-07-2022 The learned Counsel for the applicant submits that while dismissing the first application by this Court vide order dated 13-082021, liberty was granted to the applicant to move a fresh application, if there is no effective hearing in the trial, in the next eight months. 2.

It is submitted that as there was no progress in the trial, he has filed the present application without approaching to the trial Court. Accordingly, he prays for withdrawal of the present application with liberty to approach to the trial Court by filing a fresh application in view of the liberty granted by this Court vide order dated 13-08-2021. 3.

Permission to withdraw the present application is granted with liberty as prayed for.
