JULY 28, 2025 By present application, the applicant, who is in jail, is seeking to condone delay of 765 days in filing the appeal. He has been convicted under Section 302 of the Indian Penal Code, 1860, and is sentenced to undergo life imprisonment.
2] The reason why there occurred delay is the inability of the applicant to appoint an Advocate. According to the applicant, he has limited source of income. Another ground is that his relatives were not aware of the impugned judgment and, therefore, could not arrange Advocate for preparing the appeal. 3] In view of above and for the reasons set out in the application, the same is allowed, as prayed for. Delay of 765 days in filing the appeal stands condoned. Appeal be registered and processed as per Rules. 4] The application is disposed of.
