The applicant, who is a bread vendor is aged 20 years and is in custody since 09.04.2018 in connection with Crime 96/2018 registered for offence punishable under sections 307, 323, 504 and 506 of the Indian Penal Code. Perused the affidavit-in-reply. The incident, prima facie, has occurred at the spur of the moment due to an altercation of a trivial issue. The injured Shrikant is said to have asked the applicant to remove his two wheeler which was parked in front of his auto. This, according to the prosecution is the prelude to the incident. The applicant is alleged to have picked up a knife from a fruit cart and then inflicted two blows, one on the chest and the other on the left forearm of the injured.
Shri T.A. Mirza, the learned A.P.P. fairly states that the investigation is nearly complete and the chargesheet shall be filed soon. In view of the nature of the
ba483.18.O.odt 2 accusations, the nature of the injury suffered, the age of the applicant and the fact that there are no antecedents. I am inclined to release the applicant on bail on furnishing personal bond of Rs.15,000/- with a solvent surety of the like amount.
The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.
The applicant shall attend the Police Station Walgaon, District Amravati once in a month on every Saturday between 06:00 p.m. To 08:00 p.m. till the conclusion of the trial.
The application is disposed of accordingly.
