The applicant is seeking pre-arrest bail under Section 438 of the Code of Criminal Procedure in Crime No. 170 of 2022 registered with Police Station Sitabuldi, Nagpur City for the offence punishable under Sections 420 and 406 of Indian Penal Code.

Shri Mardikar, learned Senior Advocate for the applicant submits that applicant has supplied necessary information for which the Investigating Officer had sought custody of the applicant, therefore, custody of the applicant is not necessary. Accordingly, he prays for grant of pre-arrest bail.

On the other hand, learned Additional Public Prosecutor fairly state that necessary information has been supplied by the applicant and in that view of the matter, his custodial interrogation is not necessary. 4.

In the circumstances, as the custodial interrogation of the applicant is not necessary in this case, I pass the following order.

Criminal application is allowed;

ii.

Ad interim order dated 23rd June, 2022 is hereby confirmed.
