DATE : May 03, 2018 In this writ petition the order passed by the Additional Commissioner dated 02/05/2017 dismissing the appeal filed by the petitioner and maintaining the notice dated 13/12/2016 issued under Section 53(2) of the Maharashtra Village Panchayats Act, 1958 is under challenge.

The learned counsel for the petitioner states that pursuant to the said notice, the encroachment has been removed. He seeks liberty to file civil suit seeking relief of mandatory injunction.

In view of subsequent events, it is not necessary to entertain the writ petition. By keeping points raised open and by granting aforesaid liberty, the writ petition stands disposed of.
