By order dated 16.11.2015 the hearing of the appeal was adjourned after directing the appellant as well as the respondent to deposit costs of Rs. 1000/- each. Thereafter the appeal was listed on various occasions but the parties had not complied with aforesaid direction. On 13.04.2016 as the learned counsel for the appellant was not present the appeal was kept for dismissal today. Today also there is no appearance on behalf of the appellant. Hence the appeal is dismissed for want of prosecution under the provisions of Order 41 Rule 17 of the Code of Civil Procedure. In case the restoration of the appeal is sought it would be necessary for the parties to comply with the earlier order dated 16.11.2015.
