CORAM:

SUNIL B. SHUKRE & S.M. MODAK, JJ.

DATE :

4 th JULY, 2019.

Heard Shri A.C. Dharmadhikari, learned Counsel for the petitioner. Nobody is present for the respondents.

We have gone through the various documents placed on record in support of the contentions raised in this petition. The petitioner has basically challenged the order dated 19/02/2003, which calls upon the petitioner to hand over all the railway assets and await the further action to be taken by the Railway Authorities in respect of grant of fresh catering contract. A perusal of the order dated 16/06/2003 discloses that the contract period was already over and, therefore, the members of the petitioner-society were permitted to take part in the fresh tender process for allotment of catering contract afresh. These facts

wp.4413.02 2/2 would disclose that now the whole petition has been rendered infructuous.

The petition stands dismissed as infructuous with no order as to costs.
