By this Writ Petition, the petitioner seeks a declaration that the respondent no.1-Tahsildar does not have an authority to issue Form No.1 and Form No.2, dated 17.5.2016, thereby attaching the properties of the petitioner.

Shri V.P. Maldhure, the learned Assistant Government Pleader appearing for the respondent nos.1 to 3 states that the petitioner has filed an Appeal against the said order before the Sub-Division Officer, Saoner and it is still pending. It is stated that the issue involved in this matter and in the Appeal is the same.

In view of the statement made on behalf of the learned Assistant Government Pleader, we dispose of the Writ Petition, with a direction to the Sub-Divisional Officer to decide the Appeal filed by the petitioner as early as possible and positively

within four months.

The interim order granted on 24th May 2016 to continue, till the Sub-Divisional Officer decides the Appeal. No costs. JUDGE JUDGE sahare
