Apprehending arrest in connection with crime registered for the offence punishable under Sections 452, 324 and 504 read with Section 34 of the Indian Penal Code, the applicant seeks pre-arrest bail.
According to the investigating agency, the applicant assaulted the complainant by an iron pipe on her abdomen.
The learned Advocate for the applicant has submitted that the applicant and the complainant are neighbours and the applicant has also lodged a report against the complainant.
This Court has granted interim protection to
2 aba309.17 the applicant by order passed on 9th May, 2017 imposing condition of attendance at the police station. The investigating agency has not complained that the applicant has not co-operated with it.
The applicant, woman, aged about 42 years, claims to be serving as a Teacher and has stated that she is not involved in any crime / offence. The nonapplicant has not been able to show that custody of applicant is required for further investigation. In the facts of the case, the order passed by this Court on 9th May, 2017 granting protection to the applicant is confirmed. However, the condition imposed by this Court regarding attendance at police station on Monday and Thursday is relaxed.
The application is allowed accordingly.
