For the reasons stated in the application, as I find the same is satisfactory and explaining the delay properly, I am of the opinion that the delay should be condoned. 3.

Though, the learned counsel for the respondent No.1 is served, none appears for the respondent No.1. 4.

Ms H.N. Jaipurkar, learned AGP for the nonapplicant No.2 has no objection, if the delay is condoned. 5.

The delay caused in filing Second Appeal, is condoned. The civil application is allowed. The appeal be registered.
