IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR Writ Petition No. 2501/2020 Prathmesh s/o Vikram Banne

...Petitioner

Versus

The State of Maharashtra and ors.

...Respondents

Shri G. N. Khanzode, Advocate for the Petitioner Shri Amit Madiwale, AGP for the Respondent Nos. 1 and 2- State CORAM : NITIN JAMDAR AND ANIL S. KILOR, JJ.

DATED : 18 FEBRUARY 2021 P.C.:

The Petitioner seeks a limited relief of direction to the Respondent - Scrutiny Committee, Amravati to decide pending the caste claim of the Petitioner.

2.

The learned Counsel for the Petitioner states that the caste claim is pending almost from two years and the Petitioner is desirous of prosecuting his studies.

3.

In Writ Petition No. 600/2021, by order dated 01 February 2021, we had called for information from the Respondent - Scrutiny Committee, Amravati as to inform us about the pendency, so that we can set up realistic time table as noted while disposing of the said Petition. SMGate

wp 2501.2020.odt In spite of the repeated opportunities, the Respondent - Scrutiny Committee did not provide any correct information. 4.

The learned AGP states that the caste claim will be decided within a period of two months. It appears to be clearly an adhoc statement. But, having given opportunities to the Respondent - Scrutiny Committee, Amravati to place before us the statistics, which has been held back from this Court, we have no other option but to set a time limit by order of this Court.

5.

We direct that the Respondent - Scrutiny Committee shall decide the caste claim of the Petitioner within a period of two months. The responsibility to ensure that this time limit is adhered to is placed on the Secretary of the Scrutiny Committee, Amravati. 6.

The Writ Petition is disposed of.
