2] This is an application for condonation of 367 days delay caused in preferring the Second Appeal.
3] The reason for delay, as stated in the application, is severe health problem and, therefore, the applicant, who is from Gadchiroli, could not contact the lawyer at Nagpur.
4] The learned counsel for respondent No.1 strongly opposed the application, and submitted that the applicant has not placed medical papers on record in support of his contention.
5] I have perused the application.
936CAS 1082.2019 6] Considering the reasons assigned in the application, so also considering the distance between Nagpur and Gadchiroli, which is about 170 kilometers, this Court is inclined to allow the application.
7] Accordingly, the application is allowed.
Delay of 376 days caused in preferring the Second Appeal, stands condoned.
8] Appeal be registered.
SECOND APPEAL ST. NO. 10406 OF 2019 Issue notice before admission to the respondents, returnable after four weeks.
