This is an application for suspension of substantive jail sentence and for grant of bail. The applicant has convicted by learned Special Judge and Additional Sessions Judge, Kelapur on 5.5.2017, in Special Case No.7 of 2011, for the offence punishable under Section 7 of the Prevention of Corruption Act, 1988 and is directed to suffer rigorous imprisonment for three years and .....2/-
to pay a fine of Rs.1,000/-. He is also convicted for the offence punishable under Section 13(2) read with Section 13(1)(d) of the said Act and is directed to suffer rigorous imprisonment for three years and to pay a fine of Rs.1,000/-.
This Court has already admitted the criminal appeal on 9.5.2017 and has also granted ad interim order in favour of the present applicant thereby it is directed that the applicant should continue on bail on the same conditions as were imposed upon him during the Trial.
It is clear from the application that after judgment and order of conviction dated 5.5.2017 learned Special Judge and Additional Sessions Judge has released the applicant on bail so as to enable him to file an appeal.
During the course of the Trial, the applicant was on bail.
In that view of the matter and in view of the fact that the conviction is for a fixed duration, the criminal application is allowed. Substantive jail sentence, as imposed upon the applicant, is .....3/-
suspended during the pendency of the present appeal on the condition that the applicant shall execute fresh bonds before the Trial Court within a period of two weeks from today.
The criminal application stands disposed of.
