By present application, the applicant seeks protection under Section 438 of the Criminal Procedure Code. As per FIR dated 25.03.2017, the daughter-in-law of the applicant committed suicide on 25.03.2017. The applicant, who is the mother-in-law along with her husband Ambadas and son Manoj have been named in the First Information Report. It is stated that on account of continuous harassment, the deceased committed suicide.

Perused complaint on record. Same indicates that in the year 2015, the husband along with the deceased were residing separately at Paratwada while the applicant who is aged about 60 years was residing at Karajgaon. The allegations are principally
ABA. 312-17 against the husband. Considering the age of the applicant and as she has been shown to be residing separately, a case has been made out for grant of pre-arrest protection.

In view of aforesaid, the applicant in the event of arrest in Crime No. 170/2017 registered at Police Station, Paratwada for the offence punishable under Sections 306, 498-A read with Section 34 of Indian Penal Code, shall be released on furnishing P.R. Bond to the amount of Rs. 15,000/- with one surety in like amount. She shall co-operate with the Investigating OfÏcer and attend the concerned Police Station as and when directed. No steps shall be taken to influence the prosecution. Application is allowed.
